Hosting Agreement

This Hosting Agreement ("Agreement") is entered into between Techpullers Technology Solutions Pvt Ltd ("Techpullers," "we," "our," or "us") and the individual or entity ("Client," "you," or "your") using our hosting services. By using our hosting services, you agree to be bound by the terms and conditions set forth in this Agreement.

1. Services Provided

Techpullers agrees to provide web hosting services to the Client as per the plan selected by the Client at the time of sign-up. The services include, but are not limited to, domain registration, website hosting, email hosting, and other related services ("Services").

2. Account Setup and Use

2.1 Account Registration

The Client must provide accurate and complete information during the registration process. Techpullers reserves the right to suspend or terminate accounts that are found to contain false or incomplete information.

2.2 Account Security

The Client is responsible for maintaining the confidentiality of their account login credentials and is fully responsible for all activities that occur under their account. The Client agrees to immediately notify Techpullers of any unauthorized use of their account or any other breach of security.

2.3 Acceptable Use

The Client agrees to use the Services for lawful purposes only. Any use of the Services that violates local, state, national, or international laws, or any activities that are harmful to the network, servers, or other clients of Techpullers, is strictly prohibited.

3. Payment and Fees

3.1 Fees and Charges

The Client agrees to pay the fees associated with the selected hosting plan as outlined on the Techpullers website. All payments must be made in advance, either monthly or annually, depending on the selected plan.

3.2 Billing Cycle

The billing cycle for the Services begins on the date the account is activated and continues until the account is terminated. Fees are automatically renewed at the end of each billing cycle unless the Client cancels the Services as per the termination policy.

3.3 Late Payments

If the Client fails to make a payment on time, Techpullers reserves the right to suspend or terminate the Services until payment is made in full. A late payment fee may be applied, and the Client is responsible for any costs associated with collecting overdue amounts.

4. Term and Termination

4.1 Term

This Agreement is effective as of the date the Client signs up for the Services and will continue until terminated by either party in accordance with the terms of this Agreement.

4.2 Termination by Client

The Client may terminate this Agreement at any time by providing written notice to Techpullers. The Client is responsible for any charges incurred up to the termination date.

4.3 Termination by Techpullers

Techpullers reserves the right to terminate this Agreement and the Client's access to the Services at any time, with or without cause, upon providing notice to the Client. Reasons for termination may include, but are not limited to, breach of this Agreement, non-payment of fees, or illegal activity.

4.4 Effects of Termination

Upon termination of this Agreement, Techpullers will immediately discontinue the provision of Services, and the Client’s data and website may be deleted. Techpullers is not responsible for any loss of data resulting from termination.

5. Data Backup and Security

5.1 Backup Responsibility

While Techpullers provides backup services, the Client is responsible for maintaining their own backups of all data and content. Techpullers is not liable for any data loss or corruption.

5.2 Data Security

Techpullers takes reasonable measures to protect the security of the Client’s data. However, the Client acknowledges that the internet is inherently insecure, and Techpullers cannot guarantee the absolute security of the Client's data.

6. Service Availability and Performance

6.1 Uptime Guarantee

Techpullers strives to provide a 99.9% uptime for its hosting services. However, we cannot guarantee that the Services will be uninterrupted or error-free. Scheduled maintenance, hardware failures, and other factors may result in downtime.

6.2 Service Level Agreement (SLA)

Techpullers may provide a Service Level Agreement (SLA) specific to the Client's hosting plan, which outlines the expected level of service and any associated remedies for service failures.

7. Limitation of Liability

Techpullers shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities, arising out of or in connection with this Agreement or the use of the Services.

8. Indemnification

The Client agrees to indemnify and hold Techpullers, its affiliates, and its respective officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses (including legal fees) arising out of or related to the Client's use of the Services or breach of this Agreement.

9. Modifications to the Agreement

Techpullers reserves the right to modify this Agreement at any time. Any changes will be posted on the Techpullers website, and continued use of the Services after such modifications constitutes acceptance of the changes.

10. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of India. The parties agree to submit to the exclusive jurisdiction of the courts located in [Insert City], India, for the resolution of any disputes arising out of or relating to this Agreement.
